Is there any way the 701 kit which I'm building and which will not be
finished for a year or more can be registered as a E-LSA (Experimental
Light Sport Aircraft) so with the 16 hour course I can do the annual
condition inspection and all repairs? Or am I doomed for E-AB
(Experimental - Amateur Built where I have to have some qualified
mechanic do the annual condition inspection? It is my understanding
there is a Jan. 31, 2008 cutoff for fat ultralites to register as E-LSA,
but does this also apply to an approved 51% kit under construction?
Very confusing rules, at least to me. Thanks for any clairification you

Hi Robert,

The Experimental AB route to signing off inspections is even easier
than the E-LSA -- so long as you built the majority of the
plane. You need to request a "Repairman's Certificate" for your
plane. Then you can sign it all off. Only the person who built the
plane can get this certificate.

Robert,

As I understand it, you may have a choice. But don't consider yourself
"doomed".

First, if you have built 51% of your airplane, and it qualifies to be
registered as Experimental-Amateur Built, then YOU can do ALL of the
maintenance on it, including the annual condition inspection. (As long as
you apply for, and are granted, the Repairman's Certificate.) No further
course need be taken. You are good to go. You will probably have a 40 hour
test flight period.

Your situation is not effected by the Jan. 1, 2008 cutoff. That's for
those utilizing the " training exemption" for their 2-seat ultralights.

YOU can register your 701 as E-LSA whenever you're ready. You will
probably be assigned a 5 hour flyoff period since it is an approved kit.
But then, as you have said, you will have to take the 16-hour course to do
the annual condition inspection on the aircraft. This course, however, can
be transferred to any E-LSA or S-LSA which you might own in the future.

No, after the January 31, 2008 deadline, your Zenith kit plane under
construction can not be registered as an E-LSA. As far as I know, Zenith
does not offer any approved E-LSA kits. The 51% rule only applies to
E-AB, it has nothing to do with E-LSA.

But all is not lost. The primary builder of an amateur built aircraft
can apply for the amateur built repairman certificate for that aircraft
and then be qualified to sign off the annual condition inspections. You
will need to apply for the repairman certificate at an FAA FSDO after
you receive the airworthiness certificate. No training course is
required. It is only good for that particular person and that particular
aircraft.

As far as maintenance and annual inspections are concerned, the only
difference between E-AB and E-LSA is who can sign off the annual
inspection. The owner can perform all maintenance and repairs on either
of these types of aircraft. A repairman certificate is only required to
sign off the annual, it is not required for performing maintenance or
repairs.

Who can sign off the annual:

E-LSA: an A&P mechanic, an LSA repairman with a maintenance rating (120
hour course) or the owner if he is an LSA repairman with an inspection
rating (16 hour course).

E-AB: an A&P mechanic or the holder of the amateur built repairman
certificate for that airplane.
