Hi Geoff,

You may not be considering what I think is the most important reason
for having a transponder. It is the ability of ATC to accurately
locate you in three dimensions and guide other traffic around
you. This can happen any time you are in radar coverage - not just
when you are in specific controlled airspace.

Of course you can stay out of controlled airport airspace, but if you
navigate around the control areas you are still in a position of
higher traffic density. Put another way, even when you are outside
the formal control area for a high density airport you still are at
risk for a mid-air collision. There may be a whole bunch of VFR
fliers skirting the control areas just like you are. If none of them
are talking to ATC then only see-and-avoid can work, but if one of
them (like me) is in contact with ATC then the radar and transponder
information can be used to help avoid accidents.

It has always been my standard practice to squawk mode A and C
whenever I am in the air. This little habit has the potential to
save your life.

Presumably "explicit ATC directions" would include an assigned altitude. So
assuming you don't ignore the instructions from ATC your assigned altitude
plus the radar bounce gives ATC your 3D location. Remember that any aircraft
that doesn't have an electrical system (glider, a Cub) isn't required to
have a transponder either. So ATC is already dealing with this situation.

And then in 2010 we all change out our mode C s to Mode S. That way ATC
will know your altitude, position AND your name, address, pilot ratings ,
medical info. They need it to send your citation to you directly.....
