This is a question I think I know the answer to but others have expressed varied opinions, so I am asking the group - all of whom have had to deal with it.

Does a Kitfox Model II, built and brought in from the UK where it was inspected and airworthy, need an annual Airworthiness Certificate here in the US? I am not the builder, I am not a registered mechanic, but I do all my own work on the airplane.

I am visiting my local very experienced DAR tomorrow and even he doesn't know. The owner/operator of my local airstrip says no. My understanding of FAA regulations is that a licensed A&P mechanic can sign my logbook annually, no "certificate" necessary? I know (think?) that I could enter an annual inspection in the logbook myself if I were the original builder.

Does anyone have a definitive answer or experience? I have the feeling even my DAR isn't sure who to ask or where to look, I know the local FAA office sure didn't know.

Thanks in advance for any insight / experience. Personally I think that once the airplane is registered in the US that all airworthiness certification requirements should be the same as any US Kitfox.
BTW the DAR asked the question "are you certifcating it as Experimental or Light Sport?" so apparently I have the choice(?) (subject of a previous posting of mine).

Your questions are best answered by the EAA. They have legal staff
that deal with the FAA regs. and can counsel your DAR as to how to
proceed for this rare issue. Join then get the the web site and ask
your question. The last time I had an unusual question I got a return
message followed by a letter as to how to deal with the FAA. The
email and letter had inputs from several EAA experts. Great service
and I really think they do a good job.

I don't know whether your Brit AW cert transfers. I suspect not. You'll probably need a one-time airworthiness inspection from FAA inspector or a DAR to get a US AW cert. Thereafter, you'll need to log a annual "condition inspection." Since you're not the builder you can't get a repairman's certificate to sign off yourself. It will have to be done, or at least signed off on, annually by a licensed A&P mechanic.

Thanks Paul - I have spoken to a DAR on this list and he also recommended
that I need a form from the EAA. I have been a member of the EAA, and AOPA,
for many years but this is the first time I have heard about asking a
question on their site.

I have sent in my questions to the EAA and will post anything relevant I
find out on this thread.

Thanks Marco - The UK does not have an official "Airworthiness Certificate" for what was registered as a Microlight - rather we have an annual "Permit to Fly" issued by the PFA (Personal Flying Assoc) instead of the CAA (Civil Aviation Authority); partially why I am so confused over this.

The "one-time" AW Certificate and annual condition inspections clears thing up for me. I have spoken to a DAR and he thinks I can certificate it as an Experiment Light Sport, take a short course to get a repairman's certificate and then do the annual inspections myself. Apparently I can't do that if it is certificated as Experimental.

EAA follow-up - I spoke with a gentleman at the EAA and he highly recommends
applying as Experimental Light Sport and then taking the 16 hour course to
get a repairman's certificate so I can sign off my own annual inspections.

I was lucky in that I got my N number last August, before the January
deadline for Light Sport applications. As an EAA member I can take advantage
of their exemption to certificate as Light Sport even after the deadline,
they will send me an exemption form to send with the Airworthiness
Certificate application.

Thanks Jim, I have already spoken to an EAA representative (see my previous posting that starts with "EAA follow-up") and received my Light Sport exemption documentation. Boy they are good over there at the EAA, and well worth the membership fee!
