Stared unwrapping my wing kit and found a dented0 tank. I think the shipper did it but I can't really prove it.
Should I take a rubber hammer to it and then check0 for leaks, leave it alone, or? Any ideas would be helpful. I'm not up on this0 picture thing. I hope this is the right size or I'm ducking for cover. Here it0 comes.

Dave,
Try and get insurance to cover and Zenith to send a new one at no charge. Good luck though!
I got a damaged part from them 16 months ago and have received no satisfaction - even though I paid extra for insurance and have offered to take other needed (and less expensive items) in exhcange. Almost no answer or anything from Zenith - especially Subastian. He answered one email because I "threatened" to let others know how Zenith was NOT handling this issue. His answer berated me for "threatening" to expose him and Zenith.
I did learn to make sure my name is on the insurance if you pay extra for it, not the shipper.
Bottom line, make an effort with Zenith. When and if they do not reply with any satisfaction, try to fix the tank you have and good luck.

Dave,
The picture looks0 small enough to me although I have a high speed server and the Telephone modem0 folks might think it's too large.
As for the dented0 tank, the people that shipped it to you should be notified first I would think0 just to see what they are willing to do about it. They may ask you to0 return it to them at their expense and provide you with a replacement then deal0 with the shipper themselves

Bob,
I sent ZAC an email and the same picture I posted0 here. I don't really expect anything, but, who knows.
I'll wait and see what happens, then probably take0 it to a friend who is a metal expert and let him pound on it. It's an0 outboard auxiliary tank that may not get used much, and the dent probably will0 be negligible on the fuel, but I hate having something that is brand new get0 screwed up before I even use it. Thanks for the replies from0 everyone.

That is the rear of the tank, there is a few inches of space in front of the rear spar. the tank will fit, if it doesn't leak you can use it. Good luck on proving the shipper did it.....

You might want to work that out with a body and fender guy in your area if you are stuck with no support from the shipper and factory. Drill 1/8" holes where you have to pull out the bends. That will give you a place to pull from. Afterward, you can enlarge the holes to 5/32"to get them round, and fill them with A5 rivets and ProSeal. As you said, it doesn't have to be perfect, just get it close to the correct general shape.

Hello Dave:
You don't have to "prove" the0 shipper did it. I have gone through periods where UPS and surface shippers0 seemed to lose or damage half our shipments. They are used to processing0 claims caused by their "valued employees". Terms usually say that the0 product becomes the customer's property when it is turned over to the shipper,0 but real world customer relations usually dictates that the vender has to0 do the claim work IF they picked the shipper! If you demanded a certain0 shipper be used, then the factory feels no obligation to step in. Did ZA0 use their usual shipper? Do you still have the packaging? Did ZA0 pack it adequately for the type of product? I would first call ZA, send0 them the picture and ask them if they want to repair or replace the tank, they0 can then make a claim against their shipper. If it's a shipper they use a0 lot they will have "leverage" with the shipper. If ZA did not pack the0 shipment correctly, then they are directly responsible for the damage and should0 fix things. If ZA says you are on your own with the claim, call the0 shipper and make a claim, they usually send out a rep to inspect the damage0 goods AND the packaging. They are used to doing this. If anyone0 along the way tries to blow you off, start climbing the ladder until you talk0 with someone that can make things happen.
Why would you want to put0 damaged parts in your new airplane? Give ZA a chance and work with them,0 we all know they are very customer oriented.
Something I learned with0 UPS: When we make a claim, and the argument starts about "values" etc. we0 demand they send a Rep out to talk to us, they say they will, but the claim gets0 settled, the Rep never shows. Conclusion: UPS would rather settle almost0 any claim before they will send a Rep out to the premises.
Of course, all the above assumes0 the item left ZA properly packed, was then damaged by the shipper. If you0 unpacked the properly packaged tank, got excited and dropped it against the0 corner of your workbench, the above comments do not apply.
Don't settle and good luck.

Well said Randy and exactly my experience as well.0
My kit crate showed minor damage which I noted with0 the freight driver at delivery but he failed to make a note on his paperwork (no0 big surprise....). As I inventoried, found several parts damaged. ZAC took my0 claim to the freight guys and I contacted them on my end as well since it was0 handed off from Yellow Frt. to RAC locally. The rep showed, there was no hassle0 or argument even though the driver's documents didn't note damage. Got ZAC quote0 on replacing all the parts and the freight outfit cut the check.
UPS has delivered a couple of boxes of sheet metal0 that looked good outside but were damaged outside and ZAC has replaced those0 pieces no charge. Don't know if they're getting money back from UPS but I0 haven't been left holding the bag yet.

Randy,
Another thing Dave0 can do if the insurance starts to balk is ask them if they would like to get0 involved in a "Bad faith Law Suit" This has worked like a charm for me0 when I moved to Texas after retirement the moving company lost 22 cartons of0 goods for a total of almost $6,000.00. When the adjuster tried to talk me0 down, I told him that I had bought movers insurance because haveing spent 220 years in the USAF and changing stations many times I was well aware of how0 moving companies operateand how they lose and damage house hold goods and0 furniture. Anyway when I said I had talked to an attorney and been advised0 to not argue with them just tell them I will see you in court after you receive0 a summons and my lawyer will be asking for much more in a bad faith suit. 0 They paid every cent of my claim at once.
