In the UK, and some other European countries, this issue is not an academic one!
We have no 'Experimental' Category in the UK and can only fly Type Certificated aircraft, UNLESS they fall into certain categories, such as Home-builds of certain approved sorts; certain 'Classic' aircraft etc.
One category is 'Ex-military' and our CAA is obliged to give us a Permit to Fly, for aircraft that are 'Ex-military'. Usually they will do this and are normally fairly flexible about their definition. Having said that, they need to have it proven that the actual aeroplane in question served with a military arm somewhere in the world. The position with Yaks has been that Yak-50/52/55 all served with DOSAAF. Whatever might have been written about this DOSAAF categorically was military in every way, except that the members of DOSAFF usually had other civilian jobs.
However, it has led to absurdities, such as the one whereby we can fly Yak-52 manufactured until the end of 1992, while those after 1st January 1993 are considered to be 'Civilian' aircraft, and while otherwise identical, not deemed to be 'Ex-military'.
