Would a copy of the FAA form 8000-38 that Zenith filled out to establish
that the kit meets the 51% rule be something that would be good to show the
DAR or FAA when getting our planes inspected for an airworthiness
certificate?
Tim, you said comments appreciated.
I dislike dealing with speculation or statements without factual background
("I remember reading once..."), but if we could get the truth on this matter
about inspection lists I doubt 8000-38 is really for the builder. It seems
that "I read once..." that it was for the kit manufacturer OR the builder
with an exp-ab that was using lots of parts from another a/c or two.
No facts in my statement, but asking ten different FSDO or MIDO offices will
get you ten interpretations. The FAA guys are here but they're not
necessarily here to help us with actual readings of the regs. Has anyone
called Joe Norris at the EAA on this?
You could have the form ready if you think it would grease the inspection
process. With the way the inspector types and DARs differ, anything can
help, but be ready for them to just brush it aside and catch you somewhere
else.
cheers jeff HDS/3300 do not archive as the stuff below can be interpreted
in many ways
+++
e. Checklist. The FAA Form 8000-38,Fabrication/Assembly Operation Checklist,
is used by the
FAA as an aid in determining if a manufacturer's aircraft meets the major
portion requirements of
section 2 1.19 1 (g).
AC 20-139 413196
+++ Notice it says Plans-built a/c in next section AC 20-139 413196
b. Completed Kit-Built Aircraft. When a kit has been evaluated and published
in the listing of 4
eligible amateur-builta ircraft kits, and no commercial assistance was used
in the construction of the x
aircraft using the evaluated kit, the AS1 or DAR will not be required to
make another major portion rule
determination for the completed aircraft.
c. Plans-Built Aircraft.
(1) During final inspectionf or compliancew ith section2 1.191( g), a
plans-built aircraft must be
evaluatedu sing the FAA Form 8000-38a s a guide. If the builder intendst o
utilize commercial
assistancet,h e FAA Form 8000-38c an be submittedt o the FAA prior to
construction,l isting the taskso r
processesfo r which the commerciala ssistanceis proposed.I t shoulda lso
show the intendedf abrication
and assemblyt askst he builder will perform. On the basiso f this
pre-constructionc hecklist, a builder of
a plans-built aircraft should be able to obtain an evaluation in writing
from the AS1 or DAR of the effect
that the proposedc ommercial assistancew ill haveo n the major portion
requirementf or the completed
aircraft.
+++ And this sure seems like it's directed at someone evaluating a
manufactuer's kit - perhaps for the 51% rule.
