Looks like you have a second chance at this almost “lost forever” opportunity. You must have seen this 51% rule news - planning to get a submission together? Seems that would incredibly simplify the potentially arbitrary individual review of each kit now required and enhance your market appeal. FAA may question the legitimacy of your builder assist however. You pays your money, you takes your chances.

FAA Ends Moratorium on Kit Evaluations
September 18, 2009 — The FAA today (Friday, September 1, officially ended its temporary suspension of amateur-built aircraft kit evaluations which was in effect since February 2008. The action, outlined in FAA Order 8130.35, allows kit manufacturers to resume submitting their homebuilt kits for FAA evaluation to determine compliance with the major portion rules governing amateur-built aircraft certification. Compliance means inclusion on the FAA’s “51 percent approved list.”
“This order defines the policy and procedures for the formation of a National Kit Evaluation Team (NKET) and establishes a standard methodology to evaluate amateur-built aircraft kits,” wrote Frank Paskiewicz, manager of the FAA’s production and airworthiness division, in communicating the resumption of FAA evaluations. The order also describes the selection and orientation of NKET members; the process for requesting an aircraft kit evaluation; the conduct of evaluations; and reporting and records maintenance requirements.
In an e-mail communication with EAA, Paskiewicz confirmed that kit manufacturers can once again start to apply for evaluations per instructions contained in the order on page 2.2.

I see no mention on new website of process for customer to specify what percentage of completion an ordered ELSA would be shipped with or the cost ratios involved. Some manufacturers are standardizing at 75 or 90 or even 99% without being honest about the operational restrictions ELSA carries with it versus a fully factory built RTF SLSA. For the manufacturer, ELSA offers a chance to sell discounted “nearly RTF - 50 hr build instead of 500” aircraft while also possibly avoiding most of the product liability burden (“hey, don’t come crying to us if the wing delaminated and fell off - he built it himself”).

COMMENT: looks odd to specifically list Matco and McF but then not give the name of the canopy benders (you DO on the LSA page). Supplier quality problems and changes or ??? You don’t list all other parts like tank manufacturers so either mention windshield Inc (not INC) drop that canopy BS and just polish the knobs of Matco and McF.

COMMENT: “Takeoff is simple” ? Would be simpler (but construction more challenging and empty weight higher) with nosewheel steering. Would also shorten takeoff roll. Ideal solution to both and added utility? Get to work on a goddamned conventional gear (taildragger) option! OK - some dumbasses with numb feet can’t master taildragger ground ops but for the rest of us (especially those living on White Trash Airpark lumpy grass strips or flying backcountry), this aircraft is begging for it.

COMMENT: Fleet hours is actually a critical number for Arion to continue updating. The lying sacks of shyte Erwin and his crew at now bankrupt and gone CZAW (reborn under new Sportcruiser owners) refused to support their hundred english kit builders and routinely lied about production and certification dates they knew they were sabotaging back in Czechland. The english authorities rely heavily on accumulated fleet experience elsewhere before approving for english kit builders. The owners - some already waiting years since deposits and promised delivery - had to take an international poll themselves to provide this number and get certified. Arion may need it as part of your belated application for 51% status - the higher the better as it is an indicator of success and reliability. Owners should update the factory every four months until the 51% is approved and biennially after. The next FAQ “does meet” is lying bullshyte. Substitute “should meet.” You do NOT meet the 51% rule until the FAA says you do. This is what got the industry in trouble and the rule frozen in the first place so learn your lesson. More than wishful thinking is involved especially with the increasing number of manufactured subcomponents (ex: bench tested plug and play avionics-equipped instrument panels) and prebuilt complex layups and castings where builder vs manufacturer participation should be more a question of personal talent and sophistication than credit card limit or hours involved in fabrication and assembly. EAA has whored out its principles to the principals of “homebuilt” turboprop retract single kit suppliers. Speaking of whoring ($30,000 to dodge the rule in your case suggests that for a kit a builder is supposed to finish by himself in 500 hours, he is buying 500 hours of professional labor at $60/hr), MOST fatcat builder assist centers represent prima facie violations of the 51% rule and desperately need to be reined in and brought under control in the final rule and enforcement of it. Anything goes in ELSA however!

COMMENT: There are plenty of errors but proof it yourselves. I love the airplane and will buy the first taildragger 96% ELSA, but I want nothing to do with build assist center’s blatant perversion of the intent of the Experimental Rule.

Hell, there are dozens of recurring squawks and recommended fixes just in this antiquated Matronics forum that should each be service bulletins by now. Needs urgent attention.
CZAW long denied they had any issues that should have been service bulletins but leaked documents showed numerous design and production flaws brought to their attention by the US importer. New owners Czech Sport Aircraft offer a “service directive” page with some entries not airframe flaws but problems with that hangar queen flying toilet Rotax 912 “power”plant.
