Here’s the RUS update I sent to the Recreational Aviation Foundation.
What a week!
As earlier reported, the Democrat leadership tried to strip the RUS bill out of Game and Fish Committee as “unrelated” to the work of the Committee—but since the Minnesota Recreational Use Statute was WRITTEN by the Game and Fish Committee back in 1965, Senator Carlson was able to petition the Chairman to put it back in.
In Mid-week, the Minnesota Bar Association wanted to add “clarifying” language to the bill as to what is and is not “non-commercial”. They posed a number of questions as to what is commercial and what is not—“Is a spray operation commercial? What if someone wants to land there on a charter flight—is that commercial? What if a flight instructor and student want to land there?” We conferred via telephone, and I suggested that MN/DOT Aeronautics already defined “commercial” operations—and that each person engaging in “commercial” operations had to have a State license. If that definition is good enough for MN/DOT, we could adopt it in the bill. They were satisfied—but wanted to add “staffed” to the airport definition. After conferring with RAF, we did not object.
On Friday, there was a joint House-Senate Conference Committee to resolve the different language in the bill. I was asked to provide testimony—starting at 5 p.m. The House was pulling an all-nighter to finish business—so the House members of the Conference Committee had to adjourn to the House each time a vote was called—extending the Committee time. They had been in session until 3:15 a.m. the night before—so tempers ran a bit high. I was finally called to testify at 10:30 p.m. I explained the RUS—that it offered no protection if a charge was made, or if a landowner overtly created a hazard. The questions from the committee members again centered on what is and is not non-commercial—so I explained that the issue was more incumbent on the LAND OWNER running a commercial operation than having a commercial pilot land there. That seemed to satisfy them—but the Chairman wanted to add additional language. The lawyer for the Minnesota Bar Association sat down beside me and said “Mr. Hanson’s description hit it out of the park—a short definition of the Recreational Use Statute, and what is and is not a commercial operation. We have no problem with this language, and believe that any other definition is not necessary.” We had to wait for testimony, questions, changes, and votes on the rest of the almost 100 page bill, but it passed the committee and was referred to the House for a vote on the Senate changes. We got home at 1:30 a.m.
I just received an E-mail—The bill passed—on the way to the Governor!

I've tried very hard to restrain myself and have succeeded for the most part, but must respond to this one.
Dennis, you seem to be under the impression that it is OK to post whatever is of interest to you on the KOLB list, even though it is contrary to the guidelines. SOMETIMES your posts are indirectly related and perhaps of interest to a few Kolbers by being is some way related to aviation. However, the one I am responding to now, as far as I can tell, is in no way related to KOLB AIRCRAFT.
I know the list activity has been slow in recent weeks but that does not change the guidelines nor should it be viewed as reason or justification to post whatever comes to mind. As is the case for all subscribers to the Matronics Kolb List, anything (other than personal attacks) you have to say or ask about KOLBS is welcome here. I respectfully request that you stop posting anything that does not meet the Matronics Kolb List guidelines, to this list.
If you feel a need to post this sort of thing somewhere, perhaps you should consider FACEBOOK or Google+ (obviously too long for Twitter) so the only people who see it are those who think whatever you have to say on ANY subject is worth reading.
